Fees and costs:
Our fees cover various intellectual services, particularly including telephone and other discussions both with our clients and with other people involved, attending meetings, examining documents received, drafting letters, legal research, giving legal opinions, drafting and examining procedural documents, appearing in court and during pleadings, conducting negotiations, drafting and examining agreements.
Financial conditions vary in relation to various criteria, including the urgency of the services required, the matter concerned, the lawyer’s specialization and the issues at stake.
In the majority of cases, the fees charged for our services are set on the basis of a fee rate communicated during initial discussions but, as the case may be, they might include a success fee agreed in advance.
Setting a global budget can frequently be problematic, since it is impossible to foresee the evolution and the level of difficulty of a particular case. But in specific instances this does not exclude an inclusive sum being set or, for more common types of litigation, a standing charge.
In addition to fees, costs directly incurred in managing cases are also charged to our clients, i.e. case opening and closing charges, secretarial work and correspondence, emails, photocopies and faxes, telephone calls, travel and archiving.
The method of calculating these costs is notified to our clients at the commencement of our involvement.
In addition to fees and costs, certain expenditure on the client’s behalf may have to be reimbursed. These would include court fees, copies of procedural documents, conducting domiciliary research, obtaining identity and other official documents, title registers, mortgage searches, criminal records, commercial information, interventions with third parties such as bailiffs, notaries, technical advisers, and so on.
It is normal practice, particularly in commercial cases, to request a retainer at the start of the case, and then to send fee notes and interim cost statements specifying the services covered and the costs incurred.
Professional liability insurance
Our professional liability is covered up to a limit in principal of € 15,750,000 per claim.
Basic cover of € 1,250,000 is guaranteed by the Professional Liability Policy with Ethias subscribed by the Order of French and German-Speaking Bars as well as the Order of Dutch-Speaking Bars, enhanced by second level cover of € 2,500,000 per claim with Ethias, and third level cover of € 12,000,000 per claim with the companies HDI Gerling Assurances and AIG Europe.
“Claim” means any claim made rightly or wrongly against PRAXISLAW and/or against one or more of its partners and/or against one or more members of its staff on the basis of an act or omission or a series of acts or omissions by one or more partners or members of staff, trainees or any other person for whom PRAXISLAW and/or one or more partners are responsible in the exercise of their profession as lawyers.
All claims made on the basis of the same casual event are considered to be one and the same claim. In such a case, the limit will apply for the entire firm.
